Welcome to TOPO Athletic South Africa. These Terms & Conditions govern your use of our website, competitions and any purchases made through our online store. By using this website or placing an order, you agree to these Terms.
1. About Us
TOPO Athletic South Africa is the official South African retailer of TOPO Athletic footwear and accessories, based in Cape Town and delivering nationwide.
2. Eligibility
By placing an order, you confirm that you are at least 18 years old or have permission from a parent or guardian, and that you have the legal capacity to enter into a binding agreement under South African law.
3. Products & Pricing
We make every effort to ensure product descriptions, specifications, images and pricing are accurate. However, mistakes can happen and we ask for a bit of grace in these instances.
We reserve the right to cancel an order and refund you in full in the event of stock or pricing errors. .
Please remember that colours may vary slightly between screens, and product specifications may change as TOPO Athletic updates its products.
- All prices are displayed in South African Rand (ZAR).
- VAT is included where applicable.
- Delivery costs are calculated at checkout.
- Prices may change before an order is placed.
Sizing guides are provided as a reference only. We recommend ordering your usual running shoe size unless otherwise stated on the product page.
4. Orders & Payment
Submitting an order constitutes an offer to purchase. Your order is accepted once payment has been successfully processed and we confirm your order electronically. We reserve the right to decline or cancel orders where necessary, including where stock is unavailable or a pricing error has occurred.
5. Delivery
We currently deliver within South Africa. Delivery times are estimates and may vary due to courier delays, weather, public holidays or circumstances beyond our reasonable control. Risk in the goods passes to you upon delivery.
6. Returns & Size Exchanges Policy
6.1. Free Returns & Size Exchanges
Your first return or size exchange is on us. We will cover the cost of your first return or size exchange, subject to the conditions outlined in this policy.
6.2 14-Day Trial Period
We’re confident you’ll love your Topos even more on your first long run than when you first try them on.
That's why your first purchase comes with a 14-day trial period, giving you the opportunity to return your shoes if you’re not happy with the product and only discover that after using them.
Please be fair. If the issue is sizing, we encourage you to make use of our free size exchange policy first. If the shoes simply aren’t for you when you try them on, our free returns policy is there to help.
We’re committed to reducing unnecessary waste, so we ask that you use the trial period responsibly and only use it if you genuinely thought they felt good when you first tried them on, but not on longer runs.
6.3. Fair Use
Our trial and free return policy is offered in good faith and is intended to support genuine customers. We ask that customers use this service responsibly and do not take advantage.
We reserve the right to refuse free returns or size exchanges where we reasonably believe the policy is being abused, used dishonestly, or exploited beyond its intended purpose.
6.4. Conditions
The 14-day trial applies to the first purchase only. All returns and exchanges remain subject to our returns policy and applicable consumer protection laws.
7. Product Care
Running shoes are designed for their intended purpose. We are not responsible for damage resulting from misuse, incorrect sizing, improper care, unauthorised modifications or normal wear and tear. Nothing in these Terms limits your rights under the Consumer Protection Act regarding defective goods.
8. Intellectual Property
All content on this website—including photographs, logos, graphics, product descriptions, text and design—is owned by or licensed to TOPO Athletic South Africa.
You may view or print content for personal, non-commercial use only. You may not reproduce, distribute or commercially use our content without written permission.
9. Privacy
We respect your privacy. Personal information is collected and processed in accordance with South Africa's Protection of Personal Information Act (POPIA). We share information only with trusted payment providers and courier partners where necessary to fulfil your order.
10. Limitation of Liability
To the fullest extent permitted by South African law, our website is provided on an "as available" basis. We are not liable for indirect or consequential losses arising from website interruptions or events beyond our reasonable control. Nothing in these Terms excludes rights that cannot legally be excluded under South African law.
11. Consumer Rights
These Terms do not limit any rights you have under:
- The Consumer Protection Act, 2008
- The Electronic Communications and Transactions Act, 2002
- Any other applicable South African legislation
12. Complaints
If something isn't right, we'd like the opportunity to resolve it. Please contact us first so we can assist as quickly as possible. Where applicable, disputes may also be referred to the Consumer Goods and Services Ombud (CGSO).
13. Governing Law
These Terms are governed by the laws of the Republic of South Africa, and any disputes relating to these Terms will fall under the jurisdiction of the South African courts.

16. GIVEAWAY TERMS & CONDITIONS
We love a giveaway, but please remember that this is not the Olympics. We're all human and mistakes can happen. You're entering in the spirit in which the giveaway is intended: a bit of fun.
1. Eligibility

Giveaways open to South African residents, unless otherwise stated.

Employees of the brand and anyone directly involved in administering the giveaway are not eligible to enter.

We reserve the right to verify the eligibility of any entrant.
2. How to Enter
To enter, participants must complete all entry requirements specified in the giveaway post. These may include following our social media account, signing up to our newsletter or completing another specified action.
Only entries that meet all stated requirements will be considered valid. Unless otherwise stated, each eligible participant may enter once.
3. Giveaway Period
The giveaway closing date will be communicated to participants. We reserve the right to change the date or extend the entry period when necessary.
4. Prize
Prizes are subject to availability. For example, we cannot supply a size or model that we do not stock. We reserve the right to substitute the prize with an alternative of equal or greater value if circumstances beyond its reasonable control make this necessary.

5. Winner Selection and Notification
The winner will be selected, usually by random draw unless otherwise stipulated, from all valid entries received during the giveaway period.
If the winner cannot be contacted or does not respond within 72 hours of the initial notification, we reserve the right to select an alternative winner.
We will never require a winner to pay a fee to claim the prize. Nor will we ever ask for sensitive information such a passwords or bank details.
6. Prize Delivery
Delivery arrangements and any applicable geographical restrictions will be communicated to the winner.
7. Personal Information
Personal information collected in connection with the giveaway will be processed in accordance with applicable South African data protection laws, including the Protection of Personal Information Act (POPIA), and the Promoter’s applicable privacy policy.
Information will be used to administer the giveaway, contact the winner and arrange prize fulfilment. It will not be used for unrelated marketing purposes without the required consent or other lawful basis.
8. Publicity
The winner may be asked for permission to share their name, social media handle or prize-related content for promotional purposes. Any such use will be subject to applicable law and the winner’s consent where required.
9. General Conditions
We reserve the right to disqualify entries that are fraudulent, misleading, duplicated in breach of the entry rules or otherwise in violation of these Terms & Conditions.
We may amend, suspend or cancel the giveaway where reasonably necessary due to circumstances beyond its control, subject to applicable law.
Nothing in these Terms & Conditions limits any rights that consumers may have under applicable South African law.
10. Social Media Disclaimer
Our giveaways are no way sponsored, endorsed, administered by or associated with Instagram, Facebook or any other social media platform on which it may be promoted, unless expressly stated otherwise.
By entering, participants release the relevant social media platform from responsibility for the administration of this giveaway to the extent permitted by applicable law.

By entering the giveaway, participants acknowledge that they have read and accepted these Terms & Conditions.
